Limited Warranty for Waterproofing Services

Buckshot Foundation Solutions ("we", "us", or "our") stands behind the quality of our workmanship and materials. This Limited Warranty outlines the coverage provided for our waterproofing services performed on residential and commercial properties.

1. Warranty Coverage

We warrant that our waterproofing services will be free from defects in materials and workmanship for a period of [5/10] years from the date of substantial completion, subject to the terms and conditions set forth below.

Coverage Includes:

  • Foundation waterproofing membrane applications
  • Dampproofing coatings
  • Underslab vapor barriers and waterproofing
  • Elevator pit waterproofing systems
  • Parkade and deck waterproofing (traffic-bearing systems)
  • Plaza and pedestrian deck waterproofing
  • Installation of drainage systems and weeping tiles (where applicable)

Exclusions:

This warranty does not cover:

  • Structural defects in the building foundation itself
  • Damage caused by acts of God (floods, earthquakes, extreme weather events)
  • Damage resulting from alterations, repairs, or modifications not performed by Buckshot Foundation Solutions
  • Damage caused by improper maintenance, misuse, abuse, or neglect by the property owner
  • Normal wear and tear, fading, or cosmetic deterioration
  • Water intrusion through new construction joints, expansion joints, or structural cracks that were not present at the time of service
  • Damage resulting from third-party contractors (e.g., landscaping, excavation, construction) that compromises the waterproofing system
  • Any damage covered under the property owner's insurance policy

2. Warranty Transferability

This warranty is non-transferable and applies only to the original property owner at the time of service completion. Subsequent owners may request a new inspection and quote for continued protection.

3. Claim Process

If you believe a covered defect exists, please follow these steps:

  1. Notify Us in Writing – Contact Buckshot Foundation Solutions via email at info@buckshotfs.com or call (403) 703-7054 within 30 days of discovering the defect. Provide your name, address, service date, and a detailed description of the issue.
  2. Provide Access – Allow our technician reasonable access to inspect the affected area(s).
  3. Inspection – We will conduct an inspection to determine whether the defect is covered under this warranty.
  4. Determination – If covered, we will provide a written repair plan and timeline. If not covered, we will provide an explanation.
  5. Remediation – If the claim is approved, we will repair or replace the defective materials/workmanship at no additional cost (subject to reasonable costs if excluded damage is discovered).

4. Owner Responsibilities

To maintain warranty coverage, property owners must:

  • Maintain proper property grading away from the foundation (minimum 6-inch slope within 5 feet of foundation)
  • Ensure downspouts extend at least 6 feet away from the foundation
  • Keep gutters clean and functioning
  • Not alter, damage, or cover the waterproofed areas without prior consultation
  • Promptly report any signs of water intrusion
  • Allow routine inspections if requested

5. Limitations of Liability

  • Consequential Damages – We shall not be liable for any indirect, incidental, special, or consequential damages arising from any defect, including but not limited to mold remediation, property damage, personal injury, or business interruption.
  • Maximum Liability – Our total liability under this warranty shall not exceed the contract price paid for the original service.
  • Exclusive Remedy – Repair or replacement of the defective waterproofing system is the sole and exclusive remedy under this warranty.

6. Warranty Registration

Your warranty is automatically in effect upon completion of the work and receipt of payment. No separate registration is required. However, please retain your original invoice and any maintenance records.

7. Additional Warranty Options

Depending on the service and materials used, we may offer extended warranty options or manufacturer-backed warranties. These will be detailed in your service contract and may have separate terms.

8. Governing Law

This warranty is governed by the laws of the Province of Alberta, Canada. Any disputes arising from this warranty shall be resolved in the courts of Calgary, Alberta.

10. Additional Notes

  • This warranty constitutes the entire agreement between you and Buckshot Foundation Solutions regarding warranty coverage and supersedes all prior discussions.
  • Any modifications to this warranty must be in writing and signed by both parties.
  • If any portion of this warranty is found to be unenforceable, the remaining provisions shall remain in full force and effect.
